This webinar is designed to introduce newly appointed ZBA and planning board members to the fundamentals of planning and zoning and will address core topics including: how ZBA’s and planning boards are structured and operate, the basics of traditional Euclidian zoning, area and use variances, special use permits, site plan approvals, and the subdivision process. The presentation will conclude with a brief discussion of drafting decisions.
Every action of an agency, such as a ZBA or a planning board, is subject to the State’s Environmental Quality Review Act (SEQRA). While the SEQRA statute and regulations are a bit convoluted and weirdly structured, SEQRA’s requirements are fairly straightforward. This webinar will provide a clear explanation of the SEQRA process, highlighting the basic requirements of SEQRA and explaining the differences between Type I, Type II, and Unlisted Actions. The presentation will also include an introduction to the NYS Department of Environmental Conservation’s EAF Mapper and how it can be used to facilitate preparing both short and long environmental assessment forms. The webinar will conclude with a brief discussion of drafting SEQR decisions.
Pre-existing nonconforming uses are extremely commonly in New York. However, most local governments have not proactively addressed them. This webinar will provide an overview of what a pre-existing nonconforming use is, why property owners have vested rights in continuing those uses, and how such rights can be abandoned. Additionally, this webinar will address some of the steps local officials can take to phase out such uses and facilitate enforcement of nonconforming uses that are NOT prior existing to newly adopted land use regulations.
The possession and use of adult-use cannabis was legalized in 2021 but the State only recently finalized the regulations that will govern the licensing and operation of cannabis businesses.
